Rules
Conducting the Uniform state register of legal bodies and
Individual businessmen

1) Rules of conducting the Uniform state register of legal bodies and individual businessmen (further - Rules) are prepared according to the Republic Tajikistan Law «About the state registration of legal bodies and individual businessmen» (further - the Law) and define an order of conducting the Uniform state register of legal bodies and individual businessmen (further — the Uniform state register).

2) the Uniform state register represents a uniform state information databank about legal bodies, their branches and representations, individual businessmen,
Branches and representations of foreign legal bodies (further - subjects of managing), passed the state registration according to the Law.

3) the Uniform state register is conducted by Tax committee at the Government of Republic Tajikistan and its territorial bodies (further - Tax committee) according to the present Rules.

4) the Uniform state register comprises the data provided in article 8 of the Law, and is conducted on electronic and paper carriers.

5) the Data concerning the state registration of the subject of managing), contain in a paper kind in registration business of this subject, being the basis for entering into the Uniform state register.

6) Change and addition of data on the subject of the managing, containing in the Uniform state register, is carried out by entering of new data referring to the presented documents.

7) For each data in the Uniform state register date of its entering into the Uniform state register is underlined.

8) According to a part of 4 articles 11 of the Law of data on formation of an authorised capital stock of the registered legal person are brought in the Uniform state register within one year after the state registration of the subject of managing.

9) the Uniform state register on paper and electronic carriers should be stored and be processed in a special place and in the conditions preventing plunder, loss, distortion or an information fake, and also its destruction.

10) For the purpose of prevention of full loss of the data containing in the Uniform state register on electronic carriers, the body which is carrying out registration, can develop the instruction about creation and storage of backup copies of the Uniform state register on electronic carriers which affirms the Chairman of Tax committee.

11) to data containing in the Uniform state register, including to passport data of physical persons, officials of the bodies which are carrying out registration, the state statistical body and body of the state social insurance under lists and according to the powers defined accordingly by a management Tax committee, the state statistical body, body of the state social insurance have the Permission to access.

12) According to the Law the body which is carrying out registration, as agreed with the state statistical body and body of the state social insurance develops the instruction about an order of interaction on maintenance of realisation of the state registration of subjects of managing in the terms established by the Law which affirms the Chairman of Tax committee in coordination with the first heads of the state statistical body and body of the state social insurance.

13) Interdepartmental interaction is carried out according to, a part of 4 articles 7 of the Law on the basis of the uniform organizational, authentic, uniform, transparent, methodological and programmno-technical principles, providing interaction of the Uniform state register with other state information systems and networks, including:

- The uniform requisites included in the Uniform state register;

- Uniform system of classification and the coding, used for the state registration of subjects of managing in Republic Tajikistan;

- The co-ordinated technical specification on data transmission;

- Accessors and ways of data transmission in the electronic form;

- Uniform formats of information interchange;

- Forms of the documents formed and transferred on electronic carriers.

14) the Basic way of granting of data from the Uniform state register is the daily unloading of the data in the form of files, in a format (XML), data exchange through the Internet, which
It is unloaded on the protected server (FTP).

15) In case of infringement of norms of the present Rules, officials are made answerable according to the Republic Tajikistan legislation.
